Governing Law and Jurisdiction

You agree that the Superior Court of the State of California, County of Los Angeles, if it has subject matter jurisdiction, shall have exclusive jurisdiction to hear and determine any claims or disputes between you and the City of South Gate (and/or its elected officials, officers, employees, agents and the heirs, successors or assigns of same), pertaining directly or indirectly to these Terms of Service, or to any matter arising therefrom, or any other document executed and delivered in connection herewith or therewith.
Miscellaneous
Except as expressly provided in a particular legal notice posted by the City of South Gate on the City's Website, these Terms of Service constitute the entire agreement between you and the City of South Gate with respect to the access and use of the City's Website and the Materials. The City of South Gate's failure to insist upon or enforce strict performance of any provision of these Terms of Service shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these Terms of Service. Business License Tax Refunds (Section 2.08.210)
No license tax shall be refunded unless it is determined by the tax collector that the tax has been paid in error, computed incorrectly, overpaid or collected illegally, or the business has ceased operations for reasons beyond its control, or in any other instance where the tax collector, with the concurrence of the city manager, determines that a refund of the prorated amount of an unexpired business license is appropriate and proper. No refund shall be made unless a request is received by the tax collector within one year after the payment of the license tax. With respect to the determination of whether a refund is appropriate, the decision of the tax collector is final. Refunds will only be made to the person or company that paid for the license. Refunds will apply to license fees only; late payments or penalties paid will not be refunded.
Road Mitigation Fee Program (Section 5.35.020)
If a building permit expires, is revoked or is voluntarily surrendered and therefore voided, and no construction or improvement of land has been commenced under that building permit, the fee payer shall be entitled to a refund of the fee with any interest accrued thereon, paid as a condition of issuance of the building permit. Assignment of the right to a refund may be requested in writing and by the fee payer with a notarized signature.
Permit and Procedures - Fees (Section 11.51.100)
A. Filing Fees. All filing fees established by the city shall be paid upon the filing of an application, and such fees shall not be refundable. Applications shall not be deemed complete, and processing shall not commence on any application, until all required fees or deposits have been paid.
B. Recovery of Attorney's Fees. A prevailing party in any judicial action, administrative proceeding, or special proceeding to abate or to cause the abatement of a public nuisance, or in any appeal or other judicial action arising therefrom, may recover reasonable attorney's fees in accordance with the following subsections:

The City of South Gate has created this privacy policy in order to demonstrate our firm commitment to privacy. The following discloses our information gathering and dissemination practices for the City's Website.
This City's Website contains links to other internet websites. The links on the City's Website are included as a convenience for the residents of the City. The City does not expressly or impliedly endorse any product, service, business or person represented by such links. To avoid any perception that the City of South Gate either endorses or provides favorable treatment to any private person or business enterprise, no corporate or commercial logo or direct links to a vendor or commercial website are allowed. Collection of Information
On certain occasions, the public has opportunities to share personal information online with the City while accessing and using the City's Website in order to facilitate better correspondence and service. This information includes but is not limited to email addresses, responses to surveys, and registering for services to be created.

Confidentiality of Information
The City of South Gate will not disclose the personal information of any user which is collected online while accessing or using the City's Website pursuant to Government Code ยง 6255, unless disclosure is otherwise required under federal or state law, including, but not limited to the California Public Records Act, or by court order or decree.
The City will make reasonable efforts to maintain the confidentiality of information it receives on-line to the same extent it is legally able to do so with respect to information obtained through other means. The City of South Gate will not sell such personal information to third parties or private organizations.
The City of SouthGate also does not release any information about the collection of Internet Protocol addresses to any third party, unless disclosure is required by the California Public Records Act or by court order. The City's Website will archive web server log files in order to create aggregate statistical reports, detect errors, and for security reasons. Aggregate reports about website visitors may be generated. The City of South Gate will make reasonable efforts not to have these reports contain any personally identifiable information.
